Notice and Consent to Use Electronic Signatures, Disclosures, and Documents
This Consent Agreement contains important information and disclosures that you are entitled to receive before you consent to receive electronic disclosures and documents concerning your products, accounts, and services with Mid American Credit Union.
Please read this document carefully.
As used in this Consent Agreement, the words “MACU,” “Credit Union,” “we,” “our,” and “us” apply to Mid American Credit Union, and the words “you” and “your” mean the person executing and submitting this Consent Agreement and also each additional account owner, authorized signer, authorized representative, and anyone else with the authority to exercise control over you or your accounts and services with MACU.
(i) Description of Disclosure and Consent. This Consent Agreement applies to each disclosure, notice, agreement, fee schedule, statement, record, document, and other information that MACU provides to you (collectively, “Communications”) concerning or related to each and every account, product, or service that MACU offers that you apply for, own, use, administer, or access, either now or in the future, including, but not limited to, Communications related to your applications for accounts, products, and services, the opening of such accounts, products, or services, and their ongoing use and maintenance. You understand that you have the option of receiving Communications in paper or non-electronic format, but by clicking “Accept” below, you consent to receive all Communications electronically, as described further below, and understand that such Communications may not be provided to you in paper format unless you specifically request it, as provided below. Your consent extends to Communications concerning MACU accounts, products, and services that you may apply for and to accounts, products, and services that you previously obtained or currently have or maintain, even if you were previously being sent paper copies of Communications concerning those accounts, products, or services.
Examples of Communications that may be provided electronically include, but are not limited to:
- Account agreements;
- Fee schedules;
- Periodic statements;
- Privacy policy notice;
- Notification of change in terms of accounts;
- Notification of change in terms of any agreements that you have with MACU, including but not limited to, Important Account Information for Our Members;
- Maturity/expiration notices;
- Notices or disclosures under the Electronic Fund Transfer or Truth in Lending Acts related to dispute or error resolution;
- Disclosures related to the Equal Credit Opportunity Act, Electronic Fund Transfer Act, Consumer Leasing Act, Truth in Lending Act, or Truth in Savings Act;
- Other disclosures and notices that MACU is required to provide.
Your consent to receive Communications electronically does not relieve you of or alter any obligations that you may have under your agreements with MACU or under applicable law to promptly review statements, checks, items, and other documentation concerning your accounts, services, and products for irregularities or discrepancies and to promptly report such issues to MACU.
(ii) Mode of Delivery. You understand that electronic Communications may be provided to you in a variety of ways. In some cases, the Communications may be delivered as an attachment to an email or as text embedded in the body of an email. In some cases, you may receive an email that notifies you that the Communication is available for viewing on MACU’s website. In any case, Communications will be accessible as a printable web page or in Portable Document Format (“PDF”).
(iii) Hardware and Software Requirements. In order to access, view, and retain electronic Communications, you will need, and confirm that you have:
- A computer, smartphone, tablet, or other internet access device with an internet connection and sufficient electronic storage capacity on its hard drive or other data storage unit, with an operating system (Windows®, MacOS®, iOS, or Android™) running a current version of a program that reads and displays PDF documents, such as Adobe Acrobat Reader ®, for viewing and retaining certain disclosures and capable of supporting the above. Free PDF reader programs are available online. A popular reader can be found at https://get.adobe.com/reader/.
- An email account with an internet service provider and an email software or web-based email service at which you can receive email messages.
- A printer, if you wish to print the Communications and retain your records on paper.
By “current version,” we mean a version of the software that is supported. We reserve the right to discontinue support of a current version of software for security or stability purposes. We may not support some older operating systems, web browsers, or devices, so if you are using an outdated version or device, you may need to update it in order to get access to products and services available through mobile, online, and electronically. You understand that MACU does not make any warranties on equipment, hardware, software, or internet provider service, or any part of them, express or implied, including, without limitation, any warranties of merchantability or fitness for a particular purpose. MACU is not responsible for any loss, injury, or damages, whether direct, indirect, special, or consequential, caused by any internet provider, any related software, or the use thereof, or arising in any way out of the installation, use, or maintenance of your personal computer, smartphone, tablet, or other internet access device, or related hardware, software, or other equipment.
If you discover that you are having problems receiving or accessing the electronic Communications, you must contact us immediately. MACU will not be liable or responsible for any failure to deliver Communications to you if you do not notify us of such failure or if such failure is due to your personal computer, smartphone, tablet, or other internet access device, or related hardware, software, or other equipment, or due to circumstances beyond MACU’s control.
(iv) Changes to Hardware of Software Requirements. If our hardware or software requirements change, and that change would create a material risk that you would no longer be able to access or retain electronic Communications, we will give you notice of revised hardware or software requirements. Your continued use of mobile and online banking services or other electronic applications or products and services after your receipt of such notice of revised hardware or software requirements (reasonably demonstrating that you have the ability to access Communications in their electronic form) is reaffirmation of this Consent Agreement. You also always have the option of withdrawing this Consent Agreement, as described in paragraph viii of this Agreement below.
(v) Updating Contact Information and Email Address. You understand that MACU will communicate with you via the email address that you provide and identify for MACU. You agree to provide and maintain a valid, active email address, and to promptly notify MACU of any changes concerning your contact information, including, but not limited to, changes to your email address or other electronic address or to your mailing address or phone number. You must also ensure that you have adjusted the settings with your internet service provider or email account provider to accept emails from Mid American Credit Union. You understand and agree that MACU is not liable for any third-party fees, other legal liability, or any other issues or liabilities arising from emails being sent to an invalid or inactive email address that you have provided. Once provided, you understand that you may update your contact information, including your email address, mailing address, and phone number by contacting Mid American Credit Union Member Contact Center at 316-722-3921 or 1-800-767-6228, extension 108 or by writing at: Mid American Credit Union, 8404 W. Kellogg Drive, Wichita, KS 67209.
(vi) “In writing.” All Communications provided to you in either electronic or paper format will be considered “in writing.”
(vii) Paper Copies of Communications. This Consent Agreement permits MACU, but does not require it, to provide Communications electronically. MACU may still, in its discretion, provide Communications via paper, and you must continue to review any correspondence or documents that we give or mail to you in paper format. Further, even if you execute this Consent Agreement and select or click “Accept” below, and consent to using and receiving electronic Communications, you may still request paper copies of Communications. To request paper copies, please contact the Mid American Credit Union Member Contact Center at 316-722-3921 or 1-800-767-6228, extension 108, or by writing to: Mid American Credit Union, 8404 W. Kellogg Drive, Wichita, KS 67209. To receive paper copies, fees may apply. Mid American Credit Union’s fee schedule can be viewed here https://www.midamerican.coop/fees-and-service-charges. Any paper copies will be mailed to the mailing address that MACU has on file for you.
(viii) Withdrawal of Consent. This Consent Agreement will remain in effect until you give us notice that you are withdrawing it. You may withdraw your consent to receive Communications in electronic form by calling Mid American Credit Union at 316-722-3921 or 1-800-767-6228, extension 108, or by visiting a Mid American Credit Union branch. Please be aware that withdrawal of consent will result in the termination of your access to our mobile and online banking services, and other electronic applications or products or services only available online. Any withdrawal of your consent will be effective only after we have a reasonable amount of time to process the withdrawal, and any withdrawal of consent shall not affect the legal effectiveness, validity, or enforceability of electronic Communications provided or made available to you prior to our implementation of your withdrawal of consent. Withdrawal of consent will only apply to those communications that are required by law, regulation, or rule to be provided to you in paper form. We may continue to deliver to you in electronic format other communications.
(ix) Termination and Changes. Mid American Credit Union may discontinue the provision of, or terminate, or change the terms and conditions under which we provide electronic Communications. We will provide you notice of any such termination or change as required by law.
(x) Statement of Consent. By clicking “Accept” below, you are confirming that you have the hardware and software necessary to receive Communications electronically and that you have a valid email address. You are also confirming that you are authorized to, and do, consent on behalf of all the other account owners, authorized signers, authorized representatives, and delegates identified with your Mid American Credit Union accounts, products, and services. You consent to be bound by the terms, conditions, and requirements of this Consent Agreement.
