Please read these Terms of Use (“Terms”) carefully before using the website (“Site) or Services provided by Mid American Credit Union (“Credit Union,” “we,” “us,” or “our”). 

 

By accessing this Site or using our Services, including, but not limited to, applying for membership, loans or additional shares and certificates, you agree to be bound by this Agreement and all of the Terms. If you do not agree with these terms, do not access the website, the services or any of its pages.

 

This website has been established by Mid American Credit Union for the sole purpose of conveying information about the Credit Union’s products and services and to allow communication between the Credit Union and its members. Nothing contained in any page on this Site takes the place of the Credit Union’s agreements and disclosures that govern its products and services. If any information on the Site conflicts with that in the Credit Union’s agreements and disclosures, the agreements and disclosures will control.

 

Use of Website

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are prohibited from:

• Attempting unauthorized access to our systems or networks.
• Using the services to transmit any malicious code or conduct fraud.
• Misrepresenting your identity during use of any Services. 

 

When applying for membership or Services

• You agree to provide accurate, current, and complete information. 
• You authorize us to verify your identity and perform background or credit checks. 
• Submission of an application does not guarantee approval.

The Credit Union expressly disclaims all warranties of any kind as to the use of the website, including Services, whether express or implied without limitation, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, suitability, ability to use the website without contracting a computer virus, and noninfringement. We make no warranty that the Site (a) will meet your requirements, (b) will be uninterrupted, timely, secure, or error-free, (c) the results that may be obtained from the Site will be accurate or reliable, and (d) any errors in the service or technology will be corrected.

 

Limitations of Liability

You agree that we will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including damages for loss of profits, goodwill, use, data, expenses, penalty, or other losses that resulted from the use or the inability to use the services incurred by you or any third party arising from or related to the use of, inability to use, or the termination of the use of this Site, regardless of the form or action or claim (whether contract, tort, strict liability, or otherwise), even if Mid American Credit Union has been informed of the possibility thereof.

 

This limitation includes, but is not limited to, the omission of information, the failure of equipment, the delay or inability to receive or transmit information, the delay or inability to print information, the transmission of any computer virus, or the transmission of any other malicious or disabling code or procedure. This limitation applies even if the Credit Union has been informed of the possibility of such loss or damage.

 

Force Majeure

Mid American shall not be responsible for liability, loss, or damage of any kind resulting from any delay in the performance of or failure to perform its responsibilities hereunder due to causes beyond the Credit Union’s reasonable control. 

User Warranties and Indemnification

• You warrant to Mid American that:
• All information you provide to Mid American is accurate and true.
• You will comply with the Agreement and all applicable rules, laws and regulations.
• Items you transmit do not contain viruses.

 

You agree to indemnify and hold Mid American from any loss or breach of this warranty provision.

 

Termination

Mid American may immediately suspend or terminate access to the Site in the event that we reasonably determine such suspension or termination is necessary in order to protect the Site or Mid American from harm or compromise of integrity, security, reputation, or operation.

 

Modifications

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting. Continued use of our Services after changes are posted constitutes your acceptance.   

 

Governing Law 

You may not assign this Agreement. This Agreement is entered into in State of Kansas and shall be governed by the laws of the state of Kansas and of the United States. A determination that any provision of this Agreement is unenforceable or invalid shall not render any other provision of this Agreement unenforceable or invalid.
